NO FCRA USE. Polk County Criminal History is privately operated and has no connection to a local, Texas, or federal government body. This site and its advertising partners do not offer services for credit decisions, employment screening, insurance eligibility, tenant screening, or another use regulated by the Fair Credit Reporting Act (FCRA). The site is neither a consumer reporting agency nor a private investigation firm.
1. What This Website Is
This is an independent, private reference site. It does not store official records, perform official criminal-history checks, retrieve documents, or file forms for a visitor.
Its role is to identify custodians and official systems, including the Polk County Sheriff, County Clerk, District Clerk, Texas Department of Public Safety Crime Records Division, and Texas Public Sex Offender Registry. Executive-branch public records are governed by the Texas Public Information Act, Government Code Chapter 552. Access to Texas criminal history record information is separately limited by Government Code Chapter 411.
2. Rules for Using This Site
As a condition of access, you agree not to:
- Use the site in violation of federal, Texas, or local law
- Threaten, stalk, intimidate, or harass another person with information found here
- Use site content for a credit, employment, housing, tenant, or insurance decision
- Deploy a bot, scraper, or other automated collection tool against the pages
- Attempt unauthorized access to any account, service, or system
- Interfere with site operation or another visitor's access
3. No Harassment, Stalking, or Discrimination
No information obtained here or through a linked tool may be used to harass, stalk, threaten, intimidate, or unlawfully discriminate against a person. The restriction is especially important for the Texas Public Sex Offender Registry. Code of Criminal Procedure Article 62.063 prohibits using registry information to injure, harass, or commit a crime and provides penalties for misuse. Registry access supports lawful safety awareness, not vigilantism or retaliation.
4. We Are Not a Consumer Reporting Agency
Polk County Criminal History is not a consumer reporting agency under the FCRA. It does not create a consumer report, credit report, or background-screening product. Site data and linked tools must not be used to:
- Make a credit or lending decision
- Screen an applicant for employment or continued employment
- Evaluate a tenant, renter, or housing applicant
- Set insurance eligibility, rates, or premiums
- Determine eligibility for a license, permit, or government program when FCRA rules apply
- Make any other decision regulated by the FCRA
A person who needs a report for a regulated purpose must use a legally authorized, FCRA-compliant source and follow all required notices, permissions, and procedures.
5. No Legal Advice
Site content is general information, not legal advice. It cannot determine how a Polk County charge, warrant, conviction, expunction, or order of nondisclosure applies to a particular person. A licensed Texas attorney should address advice about an individual matter.
6. No Warranties
All content and services are supplied "as is." No promise or warranty is made that:
- Information will always be complete, accurate, or current
- Outside search results will be correct, complete, or properly matched
- The site will remain continuously available
- Pages will be free from defects, errors, or security weaknesses
Polk County and Texas records can change when charges are filed or dismissed, dispositions are entered, or relief restricts access. Site content may therefore lag behind the official source. It is not a statement or certification by a clerk, sheriff, DPS, or another government office.
7. Third-Party Services and Links
Links may point to Polk County offices, Texas agency portals, legal resources, and outside search services. Following a link leaves this site's control. The destination is responsible for its content, data practices, prices, terms, and availability, and those terms should be reviewed before use.
8. Intellectual Property
Text, graphics, logos, and code are owned by Polk County Criminal History or the relevant content partner. They may not be copied, altered, distributed, or used to create another work without prior written permission.
9. Limits on Our Liability
To the maximum extent permitted by law, the site is not liable for loss or damage arising from its use, including reliance on content found here or through a linked service.
10. Indemnification
You agree to indemnify and hold the site harmless from claims, demands, or proceedings caused by your use of the site or your violation of these terms, including related legal fees and costs.
11. Governing Law
Texas law governs these terms. Any dispute arising from use of the site must be brought in a court located in Texas.
12. Changes to These Terms
These terms may be changed at any time. A revised version takes effect when it is posted on this page.
13. Cutting Off Access
Access may be restricted or ended at any time, for any reason, and without advance notice.
14. Severability
If a provision is held invalid or unenforceable, every remaining provision continues in effect. The affected language will be limited only as much as needed to make it enforceable.
15. Questions
Questions concerning these terms may be directed through the Contact page.
